Appalti di lavori a scomputo degli oneri di urbanizzazione: le linee di indirizzo del Comune di Milano per fronteggiare il caro prezzi
In relazione agli appalti di lavori da realizzarsi a scomputo degli oneri di urbanizzazione in forza di convenzione urbanistica, con la delibera di Giunta n. 1147 del 4 agosto 2022 il Comune di Milano ha approvato le linee di indirizzo finalizzate ad evitare il rischio di “fermo cantiere” per le opere in fase di esecuzione e il rischio di “gare deserte” per i lavori non ancora appaltati; rischi, entrambi, legati al fenomeno del caro prezzi.
In particolare, prevedendo una deroga parziale e temporanea (per un periodo di sei mesi dalla data di eseguibilità della delibera, 4 agosto 2022) alle linee guida comunali vigenti in tema di opere di urbanizzazione a scomputo, è possibile richiedere al Comune un adeguamento dei costi, attraverso una delle azioni previste, a seconda dei casi, dalla delibera stessa e a cui si rinvia per i dettagli.
Con l’istanza occorre comunque dimostrare la sussistenza nel caso concreto delle seguenti condizioni:
effettiva incapienza economica dello scomputo degli oneri previsto in convenzione per la realizzazione dell’opera pubblica;
reale condizione di inappaltabilità dell’opera e/o di prosecuzione dei lavori.
Le istanze potranno essere presentate entro sei mesi dalla citata data di eseguibilità della delibera in esame e saranno sottoposte alla valutazione del Comune.
