NUOVA PROROGA DEI TERMINI DEI TITOLI EDILIZI E DELLE CONVENZIONI URBANISTICHE
Pubblicata sulla Gazzetta Ufficiale n. 49 del 28 febbraio e in vigore dal 1° marzo 2026, la legge 27 febbraio 2026 n. 26 ha convertito, con modificazioni, il decreto legge 31 dicembre 2025 n. 200 (c.d. “Decreto Milleproroghe 2026”), recante “disposizioni urgenti in materia di termini normativi”.
Nello specifico, la legge di conversione ha esteso a 48 mesi la proroga già prevista dall’articolo 10-septies del decreto legge 21 marzo 2022, n. 21 (c.d. “Decreto Ucraina”), convertito, con modificazioni dalla legge 20 maggio 2022, n. 51:
dei termini di inizio e di fine lavori dei permessi di costruire, delle S.C.I.A., delle autorizzazioni paesaggistiche e delle dichiarazioni e autorizzazioni ambientali comunque denominate, rilasciati o formatisi fino al 31 dicembre 2025 (modificando il precedente termine del 31 dicembre 2024), purché i relativi termini non siano già decorsi al momento della comunicazione dell’interessato di volersi avvalere della proroga e sempre che i titoli abilitativi non risultino in contrasto, al momento della comunicazione del soggetto medesimo, con nuovi strumenti urbanistici approvati nonché con i piani o provvedimenti di tutela dei beni culturali o del paesaggio;
del termine di validità nonché dei termini di inizio e di fine lavori previsti dalle convenzioni di lottizzazione o dagli accordi similari comunque denominati dalla legislazione regionale, nonché dei termini concernenti i relativi piani attuativi e qualunque altro atto ad essi propedeutico, formatisi fino al 31 dicembre 2025 (anche in questo caso modificando il precedente termine del 31 dicembre 2024), purché non siano in contrasto con i piani o provvedimenti di tutela dei beni culturali o del paesaggio.
